Encore Media Group and Encore+ Privacy Policy

This Privacy Policy is important and we ask that you take the time to read it carefully. As a user (“User”) of Encore+ (“Encore+”) and our arts organization clients (“Clients”) you are entrusting your information to Encore+. This Privacy Policy is to help you understand what data is collected, who is collecting it, why we collect it, and what we do with it. We hope you will take time to read it carefully. And remember, you can find controls to manage your information and protect your privacy and security.

We collect information from Encore+ that allows us to personalize and improve the User experience.

Real World Example: We track all user activity on Encore+. This includes how often content is being posted, who is posting the content and how often content is accessed. We provide recommendations to our Encore+ Clients with data to help them better improve the User experience and we also use this data to improve our technology.

Encore+ displays some personal information to other users and visitors who register on Encore+, which allows users to identify each other.

Real World Example: Any User who registers to use Encore+ will be able to belong to certain channels and communicate with one another. This may include leaving comments and questions, participating in polls and surveys, volunteering, and other general communication. All content that is submitted into Encore+ can be viewed by Encore+, the Client and their administrators. Additionally, Encore+ staff, in the course of their duties, may also review the content that is submitted at the request of our Client(s) in order to help them with a variety of requests. Contributors on Encore+ will have their first name, last name, and may include a photo to be shared. Encore+ has no control over the comments and uploads received from or posted by Users, any decision to publish comments or not publish comments is at the sole discretion of the Encore+ Client and remains solely their responsibility to moderate all content as they deem fit. Users of Encore+ can decide to share and submit whatever they wish through Encore+ and they may reveal more personal information beyond those basic identifiers. It is ultimately up to the Encore+ Client to address if they are uncomfortable with the nature of type of comments a User is submitting. The only time Encore+ may become involved is if we are notified that an Encore+ User or an Encore+ Client are violating the Acceptable Use Policy. If Encore+ is made aware of this we will do an appropriate investigation and inform the Encore+ Client of our decision to block one of their Users. Encore+ reserves this right to ensure the safety of Users and also reserves the right to cancel the license of our Client(s) if they are found to be violation of the Acceptable Use Policy.

What We Collect

We are collecting the information you are giving us.

Information Collected Upon Registration: When someone registers to use Encore+, some personal information is provided, such as their name, username, password, and email address. Some of this information, for example name and/or organization name and username, is listed publicly on Encore+.

We only want to send emails that actually help improve the User experience! To do so, we need to find out what doesn’t work.

E-Mail Communications: We may receive a confirmation when you open emails from Encore+. We do this to understand what you find helpful and what you find annoying. If you email us, we may keep your message, email address and contact information to respond to your request. We will provide an unsubscribe feature to ensure you have the power to not be annoyed!

Location Information: You may choose to publish your location. You may also tell us your location when you enable your computer or mobile device to send us location information. Knowing where you are helps us understand things like your time zone and offer up recommendations that mean something to you. We may use and store information about your location to provide features of Encore+, and to improve and customize Encore+.

Cookies: Our cookies are calorie free. They help Encore+ remember things and improve your overall experience including making certain features available offline on your phone.

We use “cookie” and service-worker technology to make Encore+ available when not connected to the internet. A cookie is a small data file that is transferred to your computer’s hard disk. Encore+ may use both session cookies and persistent cookies to better understand how you interact with Encore+, to monitor aggregate usage by our Users and web traffic routing on Encore+, and to customize and improve Encore+. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some Encore+ features may not function properly if you disable cookies.

We are tracking how you come to us and other system information so we can get an idea on how to make Encore+ efficient.

Log Data: Encore+ automatically records information (“Log Data”) created by your use of Encore+. Log Data may include information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms, and cookie information. We receive Log Data when you interact with Encore+, for example, when you visit or sign into Encore+, interact with our email notifications or use your Encore+ account to authenticate to a third-party website or application. Encore+ uses Log Data to provide and to measure, customize, and improve our technology.

We see where Users are clicking within Encore+ so we can know what Users are actually interested in!

Links: Encore+ may keep track of how users interact with posts within the Encore+, but also how you interact with Encore+ including our email notifications, third-party services, and Client applications, by redirecting clicks or through other means. We do this to help improve our services and to be able to share aggregate click statistics, with our Client(s), such as how many times a particular link was clicked on.

We use other companies to help us deliver Our Services.

Third-Parties: Encore+ uses a variety of third-party services to help provide features in Encore+ including Stripe and PayPal for example. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. Third-party advertising partners may share information with us, like a browser cookie ID or cryptographic hash of a common account identifier (such as an email address).

We leverage other services you are already using to make our platform stronger. Real Word Example: Users with a Facebook account can use it to log-in to Encore+.

Cross Posting: If we connect Encore+ to another service in order to cross-post between Encore+ and that service, the other service may send us your registration or profile information on that service and other information that you authorize. This information enables cross-posting, helps us improve Encore+, and is deleted from Encore+ within a few weeks of your disconnecting your account on the other service(s).

What Do We Share and Disclose?

Not much. We do not disclose your private personal information except in the limited circumstances described here.

Your Consent: We may share or disclose your information at your direction, such as when you authorize a third-party web client or application to access your Encore+.

Service Providers: We engage service providers to perform functions and provide services to us in the United States and abroad. We may share your private personal information with such service providers subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions.
Law and Harm: Notwithstanding anything to the contrary in this Privacy Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Encore+ rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Business Transfers: In the event that Encore+ is involved in a merger, acquisition, reorganization or sale of assets or bankruptcy, your information may be sold or transferred as part of that transaction. The promises in this Privacy Policy will apply to your information as transferred to the new entity.

Non-Private or Non-Personal Information: We may share or disclose your non-private, aggregated or otherwise non-personal information, such as your public user profile information, or the number of users who clicked on a particular link.

Modifying Your Personal Information

If you use Encore+, we provide you with tools and account settings to access or modify the personal information you provided to us and associated with your account.

Under 18?

Encore+ is uses Progressive Web App technology that allows our Clients to engage any audience. It is up to the sole discretion of our Clients to put in policies and controls that ensures they are compliant with all laws as it pertains to the engagement of any person under the age of 18.

EU Safe Harbor Framework

Encore+ complies with the U.S.- E.U. and U.S.- Swiss Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. To learn more about the Safe Harbor program, please visit the U.S. Department of Commerce website.

Access to Information

You have the right to request access to the information we have on you. You can do this by contacting us at privacy@encoremediagroup.com. We will provide you with a copy of the data we process about you. In order to comply with your request, we may ask you to verify your identity. We will fulfill your request by sending your copy electronically, unless the request expressly specifies a different method. For any subsequent access request, we may charge you with an administrative fee.

Information Correction & Deletion

If you believe the information we have about you is incorrect, you are welcome to contact us so we can update it and keep your data accurate. Any data that is no longer needed for the purposes specified in Information Collection and Use will be deleted. If at any point you wish for Encore+ to delete information about you, you can simply contact us at privacy@encoremediagroup.com.

Changes to this Policy

We may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at encoremediagroup.com/encore-plus/privacy. If we make a change to this policy that, in our sole discretion, is material, we will notify you via email to the email address associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
Effective: July 1 2021, irrespective of which country you reside in or supply information from, you authorize Encore+ to use your information in the United States and any other country where Encore+ may operate.
